Terms of Service

1. Who we are and what these terms cover

PolyCat ("PolyCat", "we", "us") is a software service established and operated within the European Union. These Terms of Service ("Terms") govern your access to and use of the website polycat.io and the PolyCat software service (together, the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. What PolyCat is — and what it is not

PolyCat is a software automation tool. It monitors publicly visible trading activity of wallets you select on the Polymarket prediction market platform and, using credentials you provide, automatically places corresponding orders from your own Polymarket account according to limits you configure.

PolyCat is not: (a) a gambling operator, bookmaker, or betting exchange; (b) a broker, investment firm, or portfolio manager; (c) a financial, investment, tax, or legal advisor; (d) affiliated with, endorsed by, or operated by Polymarket. All trades are executed on Polymarket, under your own Polymarket account, at your own initiative through the configuration you choose. PolyCat provides no recommendations and no advice; wallet activity displayed in the Service is public blockchain data, not an endorsement.

3. Eligibility and your legal responsibility

You must be at least 18 years old (or the age of majority in your jurisdiction, if higher) to use the Service. You may only use the Service if you hold a valid Polymarket account that you are legally permitted to hold and use in your jurisdiction. Polymarket is unavailable or restricted in certain jurisdictions (including, at the time of writing, the United States and France). You are solely responsible for ensuring that your use of Polymarket and of the Service is lawful where you live. We do not verify, and cannot verify, the legality of prediction-market participation in your jurisdiction, and we do not assist in circumventing any platform's geographic restrictions.

4. Your account

You must provide accurate information at registration and keep your login credentials confidential. You are responsible for all activity under your account. Notify us immediately at support@polycat.io if you suspect unauthorized access. We may suspend or terminate accounts that violate these Terms.

5. Wallet credentials and how we handle them

To place orders on your behalf, the Service requires the private key of the wallet you use with Polymarket, and your Polymarket account address. Your private key is encrypted using AWS Key Management Service before storage and is decrypted only transiently, per operation, for the sole purpose of signing Polymarket orders within the limits you configure. Our systems are designed to use your credentials exclusively for placing orders on Polymarket — never for withdrawing, transferring, or otherwise moving funds.

You acknowledge that: (a) providing a private key to any third-party service carries inherent risk; (b) you should use a dedicated wallet containing only funds you intend to trade with; (c) no security measure is absolute, and you provide credentials at your own risk. You can delete your stored credentials at any time from the Connect page, which removes them from our systems.

6. Subscriptions, billing and refunds

The Service is offered via paid subscription plans, billed in advance through our payment processor (Stripe). Prices are shown at checkout. Subscriptions renew automatically until cancelled; you can cancel at any time via Settings → Manage subscription, and cancellation takes effect at the end of the current billing period.

By purchasing a subscription you request immediate access to a digital service and acknowledge that, once the service has begun, you lose the statutory 14-day right of withdrawal applicable to distance contracts under EU consumer law. Except where required by law, payments are non-refundable. If you believe you were charged in error, contact support@polycat.io.

7. Trading risks — read this carefully

Prediction-market trading involves substantial risk, including the total loss of all funds you trade with. By using the Service you acknowledge and accept that:

(a) Past performance of any trader or wallet is no indication of future results. A trader who has been profitable may lose, including immediately after you begin copying them.
(b) Copied orders execute at the price available when your order reaches the market, which may differ from the copied trader's price ("slippage"). Copies may also fail entirely (insufficient balance, market minimums, liquidity, technical faults).
(c) The Service depends on third-party systems (Polymarket, blockchain networks, hosting providers) that may fail, change, or restrict access at any time, which can cause missed trades, delayed trades, or duplicated behavior.
(d) You alone choose which wallets to copy and what limits to set, and you bear all trading outcomes. Nothing in the Service is a recommendation.

Never trade with funds you cannot afford to lose. If trading causes you distress or you believe you may have a gambling problem, stop using the Service and seek support in your country.

8. Acceptable use

You agree not to: (a) use the Service in any jurisdiction where doing so is unlawful; (b) violate Polymarket's own terms of service; (c) reverse-engineer, resell, or provide the Service to third parties; (d) use the Service for market manipulation, money laundering, or any unlawful purpose; (e) attempt to access other users' data or disrupt the Service. We may suspend or terminate accounts engaged in prohibited use without refund.

9. Availability and changes

The Service is provided on a reasonable-efforts basis without uptime guarantees. We may modify, suspend, or discontinue features at any time. We will make reasonable efforts to notify users of material changes. Trade detection speed, execution success, and all figures shown in the Service are indicative and not guaranteed.

10. Disclaimer of warranties

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, or uninterrupted operation, to the maximum extent permitted by law.

11. Limitation of liability

To the maximum extent permitted by applicable law: (a) PolyCat shall not be liable for trading losses, lost profits, lost data, or indirect, incidental, special, or consequential damages arising from your use of the Service, including losses caused by missed, delayed, failed, or duplicated trades; and (b) PolyCat's total aggregate liability for any claims arising out of or relating to the Service shall not exceed the total subscription fees you paid to us during the twelve (12) months preceding the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited under mandatory law, including liability for gross negligence or intent, or your statutory rights as a consumer.

12. Indemnification

You agree to indemnify and hold PolyCat harmless from claims, damages, and expenses (including reasonable legal fees) arising from your breach of these Terms, your violation of law, or your violation of third-party terms (including Polymarket's).

13. Termination

You may stop using the Service and delete your account at any time (Settings → Danger zone, or by contacting support). We may suspend or terminate your access for breach of these Terms, suspected unlawful activity, or where required by law or by our providers. Upon termination, your stored wallet credentials are deleted. Sections 7, 10, 11, 12 and 15 survive termination.

14. Changes to these Terms

We may update these Terms from time to time. Material changes will be announced in the Service or by email, and the "Last updated" date above will change. Continued use after changes take effect constitutes acceptance.

15. Governing law and disputes

These Terms are governed by the laws of PolyCat's country of establishment within the European Union, without prejudice to mandatory consumer-protection rules of your country of residence. EU consumers may use the European Commission's Online Dispute Resolution platform (ec.europa.eu/consumers/odr) or their national consumer dispute body.
